I. FUNCTIONS OF THE PEOPLE'S COMMITTEE OF BINH PHUOC WARD:
Is a local state administrative agency, responsible to the People's Council of the same level and the higher-level state agency. The People's Committee is responsible for implementing the Constitution, laws, documents of the higher-level state agency and resolutions of the People's Council of the same level to ensure the implementation of policies and measures for socio-economic development, strengthening national defense and security and implementing other policies in the locality. The People's Committee performs the function of state management in the locality, contributing to ensuring unified direction and management in the state administrative apparatus from the central to the grassroots level.
The People's Committee elected by the People's Council is the executive body of the People's Council, the local state administrative body, responsible to the People's Council at the same level and the higher-level state agency. II. DUTIES - POWERS OF THE PEOPLE'S COMMITTEE OF BINH PHUOC WARD:
1. In the economic field, the District People's Committee performs the following tasks and powers:
1.1. Develop a master plan for socio-economic development, sectoral development, urban and rural development within the scope of management; develop long-term and annual plans for socio-economic development of the district and submit them to the People's Council for approval and submission to the Government for approval;
1.2. Participate with central ministries and branches in economic zoning; develop programs and projects of provinces, central ministries and branches; organize and inspect the implementation of assigned programs and projects;
1.3. Prepare state budget revenue estimates in the locality; prepare local budget revenue and expenditure estimates; prepare budget allocation plans of their level to submit to the People's Council of the same level for decision; prepare local budget adjustment estimates when necessary; finalize local budgets to submit to the People's Council of the same level for consideration in accordance with the provisions of law;
1.4. Direct and inspect tax authorities and agencies assigned by the State to collect budget revenue in the locality according to the provisions of law;
1.5. Develop a project to collect fees, charges, contributions from the people and capital mobilization levels to submit to the People's Council for decision;
1.6. Develop a project to decentralize investment expenditure for construction of local socio-economic infrastructure works according to the provisions of law to submit to the People's Council for decision; organize and direct the implementation of the project after it is approved by the People's Council;
1.7. Establish a financial reserve fund in accordance with the provisions of law, submit it to the People's Council of the same level and report to the higher-level financial authority;
1.8. Exercise the right to represent the owner of the State's capital contribution in enterprises and the right to represent the owner of land in the locality in accordance with the provisions of law.
2. In the fields of agriculture, forestry, fishery, irrigation and land, the Ward People's Committee performs the following tasks and powers:
2.1. Directing and inspecting the implementation of planning and development plans for agriculture, forestry, fishery and irrigation; agricultural, forestry and fishery extension programs; developing production and protecting crops and livestock in the district;
2.2. Directing the implementation and inspection of the production and use of plant varieties, livestock, animal feed, pesticides, fertilizers, veterinary drugs and biological products serving agriculture;
2.3. Making land use plans and projects to submit to the People's Council of the same level for approval before submitting to the Government for approval; reviewing and approving land use plans and projects of the People's Committees of the next lower level; deciding on land allocation, land recovery, land lease, and resolving land disputes; inspecting land management and use and other tasks as prescribed by law;
2.4. Directing and inspecting the planting and protection of upstream forests, special-use forests, and protective forests according to the planning; organizing forest exploitation according to the Government's regulations; directing and inspecting the cultivation, fishing, processing, and protection of aquatic resources;
2.5. Directing and inspecting the exploitation and protection of water resources; constructing, exploiting, and protecting medium and small-sized irrigation works; managing and protecting the dyke system, flood prevention and control works; directing and mobilizing forces to prevent and overcome the consequences of natural disasters and floods in the district.
3. In the field of industry and handicrafts, the People's Committee of the ward performs the following tasks and powers:
3.1. Develop plans and plans for industrial and handicraft development of the district; organize state management of industrial and handicraft enterprises in the district according to its authority;
3.2. Organize the implementation of industrial development programs and projects, build and develop industrial parks, export processing zones, and economic zones according to approved plans; direct and inspect the construction and development of industrial clusters, trade, services, tourism, and traditional industries, occupations, and craft villages in the district; develop agricultural, forestry, and aquatic product processing facilities and other industrial facilities;
3.3. Organize the protection of unexploited mineral resources in the locality; organize and inspect the exploitation of resources in the locality.
4. In the field of transportation, the Ward People's Committee performs the following tasks and powers:
4.1. Directing and inspecting the construction and implementation of planning and development plans for the district's transportation network in accordance with the overall development plan and planning of the central transportation program;
4.2. Organizing the management of urban traffic works, roads and inland waterways in the locality in accordance with the provisions of law;
4.3. Organize the implementation of inspection and technical safety assessment of road and inland waterway vehicles; inspect and issue vehicle circulation permits, inland waterway vehicles and driving licenses according to the provisions of law; 4.4. Organize and direct the inspection, protection of traffic works and ensuring traffic safety in the district.
5. In the field of urban construction, management and development, the Ward People's Committee performs the following tasks and powers:
5.1. Organize the preparation, submission for approval or approval under its authority of regional construction and urban construction plans in the district; manage architecture, construction, and construction land according to approved plans; approve investment plans and projects for construction works under its authority; manage construction work and grant construction permits in the district;
5.2. Managing investment, exploitation and use of urban infrastructure works, urban areas, rural residential areas; managing the implementation of housing and land policies; managing state-owned housing funds assigned by the Government;
5.3. Developing planning and development plans for construction materials; managing the exploitation, production and trading of construction materials in the district according to authority.
6. In the fields of trade, services and tourism, the District People's Committee performs the following tasks and powers:
6.1. State management of assigned types of schools and classes in the district; directly managing pedagogical colleges, vocational secondary schools, high schools, and cultural supplementary schools; training and fostering teachers in the district from pedagogical college level and below; permitting the establishment of non-public schools in accordance with the provisions of law;
6.2. Manage and inspect the implementation of teacher standards, examination regulations and diploma issuance according to the provisions of law;
6.3. Conduct inspections and examinations of education and training work in the district according to the provisions of law.
7. In the field of culture, information, physical education and sports, the District People's Committee performs the following tasks and powers:
7.1. State management of cultural, information, advertising, press, publishing and physical education and sports activities according to the provisions of law; organization and management of public service units in culture, information, physical education and sports, radio and television of the district;
7.2. Organize or be authorized to organize national and international exhibitions, fairs, cultural and sports activities in the district;
7.3. Direct and organize the protection, restoration and preservation of historical and cultural relics and scenic spots, cultural and artistic works within its authority; guide the building of a civilized lifestyle and a cultured family;
7.4. Inspect and prevent the trading and circulation of reactionary and decadent books, newspapers and cultural products.
